2. Purpose and Scope

These conditions regulate the use of the website www.blackbork.es and the sales made through it.

Accessing, browsing, and using the Services implies express acceptance of these Terms and our Privacy Policy [LINK].

3. General Description

BlackBörk ES operates this website to offer selected products and services to the customer (the “Services”), using Shopify technology.

By using the Services, you agree to comply with these Terms. If you do not agree, you must not use them.

4. Access and Account

The user declares to be over 18 years of age or to have authorization from their legal guardians.

The user is responsible for the accuracy of the data provided (email, shipping address, billing, payment methods) and for the security of their account credentials.

5. Products

Product photographs and descriptions are indicative. Colors may vary depending on the device and screen settings.

We may modify, update, or discontinue products at any time.

7. Prices, Errors and Billing

All prices include VAT.
In case of a manifest error in the price, it will be notified, and the full amount will be refunded.
Stripe is PCI-DSS compliant; we do not store card data.
The invoice will be sent electronically to the provided email; you may request a paper invoice by writing to info@blackbork.es.

8. Shipping and Delivery

Shipping available only within Spain.
Delivery time: 3 business days (9:00 AM – 8:00 PM, excluding holidays).
Up to 2 delivery attempts; after that, the package will be returned.
Risk transfers to the customer at the time of delivery by the carrier.

9. Right of Withdrawal and Returns

You have 14 calendar days from receipt to withdraw without justification.

10. Legal Guarantee of Conformity

3 years for new products (RDL 1/2007).
Defects communicated within 2 months.
Presumption of defect during the first 2 years.

11. Relationship with Shopify

BlackBörk ES uses Shopify technology to provide the Services. However, all sales are made directly with BlackBörk ES, exempting Shopify from any liability arising from your purchases or transactions.

12. Comments

If the user sends reviews, suggestions, or comments, they grant BlackBörk ES a perpetual, worldwide, royalty-free license to use them for commercial or promotional purposes.

Comments must not infringe third-party rights or contain offensive, illegal, or harmful material.

13. Prohibited Uses

The user agrees not to use the Services for illegal, fraudulent, defamatory, abusive purposes, to infringe intellectual property rights, distribute viruses, or carry out activities that may affect BlackBörk ES, Shopify, or third parties.

14. Limitation of Liability and Force Majeure

We will not be liable for delays or non-compliance due to force majeure (natural disasters, strikes, pandemics, transportation incidents, etc.).

15. Intellectual Property

All website content (trademarks, logos, texts, images, graphics, videos, designs) is the property of VirtusNova, S.L. or third-party licensors. Total or partial reproduction is prohibited without authorization.

16. Applicable Law and Jurisdiction

These conditions are governed by Spanish and European Union regulations:

The parties submit to the Courts and Tribunals of Barcelona.
